Is reusing modified Giant xml files inside my mod a violation?

Do any of you modders have any idea if redistributing xml files, such as fruitTypes.xml inside a mod is considered a violation of copyrights? I'm writing a mod, that reads a customized version of fruitTypes.xml. The xml file needs to be distributed inside the mod zip file and then put inside the modSettings folder. I would greatly appreciate your knowledge or opinion on this.

The T&C paragraph 6.8 refers to "programs other than the [Giants] games".

Of course you may use the distributed game content also in your mods. One can barely create a mod without this. Also the mods on ModHub have more or less original game content.

However another point is the usage of non-public stuff as contained in "dataS.gar" or DLCs. Since these are not accessible easily, special methods are required. And strictly spoken this might violate common DRM laws.

Thank you Bilbo for making this extra clarification. It makes good sense. I ended up making customized versions for fruitTypes.xml, fillTypes.xml and sprayTypes.xml with only the parameters my mod reads. This way, mod users do not waste their time personalizing xml content that is not read anyway.
